Terms & Conditions

By downloading, installing, or using the Hushburg app or website, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree with any part of these terms, you must stop using Hushburg immediately.

These terms apply to all users of the Hushburg platform including buyers, sellers, auction participants, affiliate members, and service providers. Using any part of the platform, even without making a purchase, constitutes acceptance of these terms.

You must create an account to access most Hushburg features. Accounts can be created using a valid Google or Facebook login. You are solely responsible for keeping your login credentials secure and for all activity that occurs under your account.

• You agree to provide accurate, current, and complete information during registration and to keep it up to date.
• You must be of legal age in your jurisdiction to enter into binding agreements.
• One account per person. Creating multiple accounts to gain unfair advantages, duplicate rewards, or bypass restrictions is prohibited and will result in all associated accounts being actioned.
• You are responsible for any activity that occurs on your account, whether authorised by you or not. Notify Hushburg immediately if you suspect unauthorised access.
• Hushburg reserves the right to suspend or terminate accounts that provide false information or violate these terms.

You agree to use Hushburg only for its intended purposes and in a manner that is lawful, respectful, and fair to other users.

• You must not use Hushburg for any purpose that violates applicable laws or regulations of Bangladesh or any jurisdiction you operate from.
• You must not attempt to reverse engineer, scrape, copy, or clone any part of the Hushburg platform, codebase, or data.
• You must not interfere with, overload, or disrupt the platform's servers, infrastructure, or other users' access.
• You must not attempt to gain unauthorised access to restricted areas, admin panels, other users' accounts, or backend systems.
• You must not use automated tools, bots, scripts, or third-party software to interact with the platform in ways not permitted by these terms.
• Any use of the platform that gives you or another party an unfair advantage over genuine users is strictly prohibited.

All purchases on Hushburg are processed through the Hushburg escrow system. Your payment is held securely and only released to the seller after you confirm delivery of your order.

• By placing an order, you authorise Hushburg to charge your wallet or chosen payment method for the total amount including any applicable delivery fees.
• All wallet top-up transactions are final and non-refundable once processed. Only top up what you intend to spend on the platform.
• Do not confirm delivery until you have inspected your order and are satisfied. Delivery confirmation releases payment to the seller and closes the transaction.
• If an order does not arrive or significantly differs from the listing, raise a dispute through in-app support before confirming delivery.
• Hushburg is not responsible for failed payments due to incorrect account information provided by the user.
• All prices on Hushburg are displayed in Bangladeshi Taka (BDT) unless otherwise specified. Seller panel fees may also be listed in AED for international sellers.

Hushburg operates a Highest Unique Bid live auction system. Participating in auctions means you accept both these terms and the specific auction rules published at hushburg.com/bd/auctionsystem.

• The seat booking fee is non-refundable in all circumstances. It covers your room entry and your 1st Call.
• Call Security deposits from the 2nd Call onward are fully refundable to your Hushburg shopping wallet if your Call does not win, following human-verified audit.
• Hushburg processes auction outcomes only after a verified audit of the closed room. Results are final once announced.
• Attempting to collude with other participants, pre-arrange winning bids, or coordinate offers to manipulate auction outcomes is a serious violation subject to immediate account action and forfeiture of all deposits.
• You agree to complete payment for any auction you win. Failure to complete payment after winning will result in the forfeiture of your Call Security and may result in account suspension.
• HBT training auctions are for learning purposes only. Items won in HBT training auctions are claimed in person at Hushburg marketing booths and have no cash or resale value.
• Hushburg auctions are not a form of gambling. There is no chance-based payout and no independent cash prize. The Highest Unique Bid format is a fixed-rule bidding competition.

HBT (Hushburg Token) is an in-app currency earned through legitimate platform activity. It has no real-world monetary value and cannot be withdrawn or exchanged for cash.

• HBT can only be used for store discounts, HBT training auctions, and seller panel subscriptions. It has no other permitted uses.
• HBT is earned through the daily tap game, daily tasks, and Interest List activity. It is not sold for real money.
• Attempting to exploit, farm, or automate HBT accumulation using bots, scripts, emulators, multiple accounts, or any other unauthorised means is strictly prohibited.
• HBT balances may be forfeited without refund if earned through cheating, exploitation, or policy violation as determined by Hushburg's audit process.
• Hushburg reserves the right to adjust HBT balances, game mechanics, and earning rates at any time for platform health without compensation.

Sellers on Hushburg must comply with all platform rules, product listing requirements, and applicable consumer protection laws in Bangladesh.

• All product listings must accurately describe the item, including its condition (new or pre-owned), actual product images, and correct pricing.
• Sellers must fulfil all orders confirmed through the Hushburg platform. Persistent non-fulfilment will result in seller panel suspension or termination.
• Seller panel fees are one-time payments with lifetime validity. Fees are not refundable once a panel is activated.
• Products listed through auction panels must comply with the product value limits: Standard Panel up to ৳10,000, Premium Panel up to ৳3,000,000. Products above ৳3,000,000 require a custom listing approved by Hushburg.
• Hushburg reserves the right to remove any listing that violates platform standards, misrepresents a product, or creates risk for buyers.
• Sellers agree that all buyer payments pass through Hushburg Escrow and are not released until delivery is confirmed. Attempts to solicit payments outside the platform are a serious violation.

The Hushburg wallet is a shopping wallet, not a financial account or savings instrument. You agree to use it only for in-platform transactions.

• A minimum balance of ৳499 must be maintained in your Hushburg wallet at all times. Withdrawal requests that would reduce your balance below ৳499 will not be processed.
• The minimum withdrawal request is ৳499.
• Withdrawals are processed within 24 to 72 hours depending on the chosen method.
• Withdrawal charges apply: 0.5% for City Bank PLC and 1% for all other methods.
• Auction Call Security refunds are credited to your Hushburg shopping wallet, not directly to external payment methods.
• Attempting to manipulate wallet balances through fraudulent top-ups, chargebacks, or payment reversals is a serious violation subject to account termination and legal action.

Hushburg's affiliate program rewards genuine referrals. You earn rewards when someone you refer joins Hushburg through your link and becomes an active user.

• Referral rewards are paid only for genuine new users who sign up through your link and meet the activity criteria.
• Creating fake accounts, using fake identities, or referring yourself through alternative accounts to earn referral bonuses is strictly prohibited.
• Any referral rewards earned through fraudulent activity will be reversed and forfeited. If the fraudulent activity resulted in wallet credits, those credits may be deducted from your balance.
• Hushburg reserves the right to modify the referral program structure, reward rates, and eligibility criteria at any time.

You may submit content to Hushburg including product reviews, comments, and images. By doing so, you grant Hushburg a non-exclusive, royalty-free licence to use, display, and distribute that content within the platform.

• You are solely responsible for the accuracy and legality of any content you submit.
• Content must not contain offensive, defamatory, misleading, or illegal material.
• You must not submit content that infringes on third-party intellectual property rights, including images, text, or trademarks you do not own.
• Hushburg may remove any content that violates these terms or community standards without notice.
• You retain ownership of your original content. Granting Hushburg a licence does not transfer ownership.

Hushburg invests significantly in maintaining a fair, transparent, and trustworthy platform for all users. Cheating, abuse, and exploitation undermine this for every genuine participant. We operate an active audit program and take all detected violations seriously.

If your account has been suspended, restricted, or if digital assets have been forfeited following an audit, you have the right to submit a formal appeal. Hushburg reviews all appeals submitted in good faith.

• Appeals must be submitted within 30 days of the enforcement action notification.
• You must provide your registered account email, a clear description of the situation, and any supporting evidence you believe is relevant.
• Appeals are reviewed by the Hushburg administration team. Decisions are typically communicated within 7 to 14 business days.
• Hushburg's appeal decision is final. Submitting an appeal does not automatically restore access during the review period.
• Abusive, threatening, or fraudulent appeals will be dismissed and may result in a permanent ban.

Hushburg collects and processes your personal information in accordance with our Privacy Policy, which is available within the app and at hushburg.com. By using Hushburg, you consent to the data practices described in that policy.

• We collect only the information necessary to operate the platform, process transactions, and communicate with you.
• Your personal information is never sold to third parties.
• We use standard industry security practices including SSL encryption to protect your data.
• You have the right to request access to or deletion of your personal data by contacting [email protected].

The Hushburg name, logo, platform design, codebase, auction system, HBT system, and all related materials are the intellectual property of Hushburg and are protected under applicable laws.

• You may not use Hushburg's trademarks, logos, branding, or proprietary materials without prior written consent.
• You may not copy, replicate, or create derivative works based on Hushburg's platform, auction mechanics, or user interface without permission.
• You retain ownership of any original content you submit to the platform. By submitting it, you grant Hushburg a licence to use it within the platform as described in Section 10.

Hushburg provides its platform on an "as available" basis. While we work hard to ensure reliability, we cannot guarantee uninterrupted service at all times.

• Hushburg is not liable for any indirect, incidental, or consequential losses arising from your use of the platform, including losses resulting from downtime, bugs, or third-party payment provider issues.
• Hushburg's maximum liability for any claim related to a transaction is limited to the value of that specific transaction.
• Hushburg is not responsible for the actions of individual sellers or buyers beyond what is covered by our escrow and dispute processes.
• We are not responsible for delays or failures caused by events outside our control including internet outages, banking system delays, or force majeure events.

Hushburg reserves the right to suspend, restrict, or permanently terminate any account that violates these Terms and Conditions, at our discretion and without prior notice for serious violations.

• Minor policy breaches may result in a warning or temporary restriction.
• Serious violations, including cheating, fraud, payment manipulation, or system abuse, may result in immediate permanent termination of all associated accounts.
• Upon termination for cause, all digital assets including HBT, seller panel access, and pending rewards may be forfeited without compensation.
• Wallet balances may be frozen pending audit. If funds are determined to have been gained through fraudulent activity, they may be deducted or withheld.
• Users who believe a termination was made in error may submit a formal appeal as described in Section 12.

Hushburg may update or modify these Terms and Conditions at any time. When changes are made, the "Last Updated" date at the top of this page will be revised.

• Your continued use of Hushburg after any changes are posted constitutes acceptance of the revised terms.
• For significant changes affecting user rights, enforcement policies, or financial terms, Hushburg will notify registered users via push notification or in-app alert before the change takes effect where reasonably possible.
• We encourage you to review these terms periodically at hushburg.com/bd/terms.
